- The General Application and Implementation Directive, enacted in March 2025, provides clarity on the scope and application of Nigeria’s Data Protection Act. It offers further details on requirements concerning data subject rights, the legal bases for processing data, and cross-border data transfers. The directive obligates data controllers and processors to register with the Data Protection Authority (DPA), appoint Data Protection Officers (DPOs), carry out Data Protection Impact Assessments (DPIAs), and report data breaches, among other duties. It also defines data controllers and processors of major importance, stipulating additional registration and annual compliance audit requirements for these entities. Furthermore, it outlines the role and enforcement powers of the DPA.
